8-24 Referral: 851R Colonel Ledyard Hwy. Granting & Revising Easement Favorable 8-24 Review

When the new entrance road to the Highway Garage/Transfer Station was constructed, the official/historic easement access to 851R Colonel Ledyard Highway was compromised at the location of the intersection of the new road and the easement access (see attachment-new roadway overlayed on existing drawing; existing easement is simply a dashed line; the dashed line in the new roadway is simply a notional realignment of the easement).  Also, the new access roadway offers a superior location of the initial 800' of easement access.  The Town has an obligation to restore the easement access.  The Town has previously granted a similar easement access over this section of roadway for 885A Colonel Ledyard Highway
